Police say woman responsible for child's drowning

Some six months after 4-year-old Torrell Malik Martin drowned in the Super 8 Motel pool, the youngster’s mother is being held responsible for his death.

Kyria Deshawne McDaniel, 27, of Beaumont, was indicted by a Jefferson County grand jury Dec. 12, 2013, on the first-degree felony of injury to a child,

According to a BPD press release, first responders were called to the Super 8 Motel at 2850 I-10 E. about 5:36 p.m. July 24, 2013, to find family members administering CPR to Martin, who had stopped breathing.

Beaumont EMS quickly took over CPR and rushed the child to St. Elizabeth Hospital where doctors were unable to save his life and was pronounced deceased at 6:32 p.m.

According to a probable cause affidavit obtained by The Examiner, when police interviewed witnesses who were at the pool that summer day, officers learned that “McDaniel, nor anyone she was with, knew anyone staying at that property, and they just decided it would be a good place to swim.”

Despite the circumstances surrounding her son’s death, McDaniel admitted that her son, Torrell, did not know how to swim and she did not provide the child with any personal flotation device.

Police say in the affidavit that McDaniel allowed her son to swim even though she knew he couldn’t and did not watch her son, which ultimately caused the child to drown.

The affidavit said McDaniel was with a “male friend” in the same pool at the time of the child’s drowning.

McDaniel was arrested Dec. 16 and posted a $5,000 bond that same day. She is set to appear in Judge John Stevens’ Criminal District Court Feb. 3
