An engineering firm hired to audit Beaumont’s water department in 2014 is asking the Ninth Court of Appeals to dismiss a defamation case against them as the first named plaintiff in the suit sits behind bars for theft and for staging her granddaughter’s fake kidnapping.

Q. We had our foundation repaired by a company that gave us a “lifetime warranty.” Now that it has cracked again they won’t even return our calls. We are not even sure if they are still in business. What are our legal rights? What kind of an attorney do we need?

The United States Court of Appeals Fifth Circuit has upheld a jury decision that awarded $2.5 million in damages against Orange County for the wrongful death of an inmate held in the county jail’s detention “bubble” for days on end as the mentally ill man died of renal failure in a pool of uneaten jail food and human waste.

Q. About two years ago, my wife and I ran into financial difficulty and made the choice to attempt to settle our credit card debt. Most creditors settled with us, but one credit card company wouldn’t settle, so we quit paying altogether. If we are sued and have a judgment against us for this debt, can our wages be garnished? I guess essentially we want to know what can happen for non-payment of credit card debt. Thank you.

Q. I am moving out of my apartment. I know a landlord cannot deduct from a security deposit for “normal wear and tear.” What is normal wear and tear? Does the statute have a definition?

Q. I had a divorce in January 2012. In the decree, a 2012 Toyota Corolla was awarded to my ex-wife. When we bought the car, it was in her name as the buyer and mine as the co-buyer. My ex-wife had been doing very well, making all the payments on this car, until April of this year. I thought my attorney had sent Toyota finance the divorce decree to show she was liable for all future payments.

Federal Judge Marcia Crone has spent nearly a year sifting through hundreds of legal documents filed as part of a civil racketeering case against roughly three dozen local, state and federal officials, as well as local media outlets and representatives, lodged by former Beaumont Independent School District administrator Jessie Haynes and contract electrician Calvin Walker. The total number of defendants in the case is dwindling, however, as just this past week two more were dismissed entirely from the litigation.

Q. My son was hired as a mechanic’s assistant at $14 an hour. He told the supervisor that he had some experience, but he was willing to learn as he went along with the job. The supervisor was fine with this, and my son was given other duties as well. My son was very happy, always on time to work, apparently no problems. Last week he was called to the office and told they had hired a previous ex-employee to come back as the assistant. My son was given the option to go work in another job, but his pay would be reduced to $10 an hour. Is this legal?
